TO: All CSEA Classified Employees

FROM: Sara DeClemente-Hammoud, Manager of Classified Service

Cheryl Robinson, Payroll Manager

SUBJECT: Over40 Comp Time

DATE: May 14, 2008

This memorandum outlines the changes to the Compensatory Time Off for Overtime Worked in the 2007-2011 collective bargaining agreements between the State of New York and the Civil Service Employees Association. These changes are addressed in Article 27 of the bargaining agreement.

The previous agreement in the 2003-2007 contract allowed employees to choose compensatory time in lieu of overtime pay for the hours worked in excess of 40 hours in a work week. Effective July 1, 2008 the following changes will be made to this program:

Over 40 Comp Time can no longer be used for time off. Participating employees still earn 1.5 hours of compensatory time for every hour of overtime worked. Participating employee may liquidate up to 120 hours in the bank one time per year payable in the payroll period closest to December 1 at the current rate of pay. Employees who enroll in the new program may now accumulate up to 240 hours maximum of Over 40 Comp Time Employees who do not re-enroll in the new program will not be eligible for the payout in December, but are permitted to use time accrued prior to 4/2/07 until it is exhausted At separation, any Over40 Comp Time will be liquidated and paid at the rate of pay at the time of the liquidation. The cash-out value is also at the rate of pay earned at the time of liquidation

Effective July 1, 2008, an employee must make an election to participate for a one-year time period. Open enrollment for this program is from May 1, 2008 to June 15, 2008.

If you have any further questions regarding these changes you may direct them to Sara DeClemente-Hammoud at X74939 or Cheryl Robinson at X72129.
